有的同学在当前身份失效，且没超出 180 天的时候，认为由于有 245(k) 的保护，所以仍然可以提交 I-485. 这种认识是不全面的。因为 245(k) 豁免的是工作移民的少于 180 天的身份违例，但是并没有豁免当前身份失效。
在来看看USCIS的 Memorandum
其中有段文字如下
3(d)(4)(C)
Failed to Maintain a Lawful Status and/or Violated the Terms of a Nonimmigrant Visa.
(1) General. Expiration, revocation, or violation of status puts a nonimmigrant out of status, and the alien remains out of status until some adjudication restores status or the alien departs the United States.
In most cases, the 180-day counting period commences on the date the alien’s status expires, is revoked, or is violated following the alien’s most recent admission.
…………….
Consequently, if the same alien files a second application for adjustment of status, the period after which the nonimmigrant status expired and during which the first adjustment of status application was pending counts against the 180-day period when considering eligibility for relief under 245(k) in the adjudication of the second adjustment of status application.

下面是 245(k) 的两个例子：
王五是 H-1B 且 I-140 的受益人，在上一次入境之后曾被 lay off 了仨月/或曾打第二份零工四周，但是现在是在依 I-129 为该雇主工作。王五现在可以交 I-485.
王五同上，太太是 F-1，但是日感学习压力颇重，上个学期只上了两门课（F-1 全日制学生要求注册三门课），现在是三门。王五太太现在可以交 I-485.
王五的例子中，USCIS可能不知道王五曾被lay off了仨月，因为雇主没报告USCIS,王五自己也不提. USCIS也不知道王五曾打第二份零工四周，因为没有1099-MISC或W-2. 或者王五还有个part time的H-1B用于打零工. 王五现在当然可以交I-485,根本不需245(k).不然的话，王五从他被lay off的那天起，或从他打第二份零工的那天起，就OOS了，并OOS到当前。他之所以现在可以交I-485,是因为他OOS还没满245(k)中的180天。根据USCIS的Memorandum

王五太太的例子中，上个学期虽然只上了两门课，也许她事先征得了International Student Advisor的书面许可。王五太太现在当然可以交I-485,根本不需245(k).不然的话，她从上个学期起就OOS了。她之所以现在可以交I-485,是因为她OOS还没满245(k)中的180天。根据USCIS的Memorandum

245(k)赦免了OOS（包括Expiration, revocation, or violation of status）我的理解对吗？请指教。
