I am a US citizen and trying to apply green card for my wife. May I ask couple questions?
1. I just became a US citizen in Jun 2012. I applied I-130 for my wife in the last October. Priority date: 10/22/2011. At that time, I was a US permanent resident. The I-130 is still in pending status now. Should I upgrade the I-130 from F2A to immediate relative, or should I file a new I-130 since I am a US citizen now? Which way is faster to get us the green card?
2. If I upgrade, should I send a fax to the USCIS California Service Center (my I-130’s center)? I found this fax number online: 1-949-389-8070, is this the right number?
3. Should I file my wife’s 485/765/131 with I130 receipt notice today? Or should I wait I130 approved, and then file 485/765/131?
4. Can I apply permanent green card instead of conditional green card for my wife, and how to do it? We have been married for more than 2 years.
5. G-325A, at the bottom of the page, there is a line below “Signature of Applicant”, named “If your native alphabet is in other than Roman letters, write your name in your native alphabet below:”. Should I leave it blank, or handwrite my wife’s Chinese name “李虹” in it? Why does USCIS need our Chinese name?
6. I-485, Page 1, Part 1. Information About You – “Date of Last Arrival”; and Page 2, Part 3. Processing Information – “Place of Last Entry Into the United States”: My wife’s current I-94 was issued on 02/14/2009 when she entered the United States in San Francisco with an F-1 Visa from China. Since then, she travelled couple times to Canada, Mexico and Puerto Rico for vacations. The last time she entered US was 04/21/2010 from Puerto Rico to New York. Since she was not issued any new I-94 in those trips, I am not sure if I should put 02/14/2009 or 04/21/2010 into the “Date of Last Arrival” box. And, should I put San Francisco or New York into “Place of Last Entry Into the United States”? The 02/14/2009 I94 is still in her passport today.
7. I-765; 12. Date of Last Entry into the U.S. and 13. Place of Last Entry into the U.S.; same problem as above, should I put 02/14/2009 or 04/21/2010 into the “Date of Last Entry into the U.S. ” box? And, should I input San Francisco or New York as the “Place of Last Entry into the U.S.”?
8. Same question as above, in the I130 I sent out in the last October, I entered 02/14/2009 as “Date arrived” in Item 14. Is it right? Should I send a letter to correct it in the same envelope of my upgrade letter?
9. May I black and white copy the driver’s license and passport? Is it necessary to be color copy? We are living in Chicago now, and I heard it is illegal to color copy driver’s license and passport in Illinois. I am not sure if it is true.
