求救! I am a single mother with a little boy and rely on my parents' help largely to take care of my little one. My mother's B-2 I 94 expired on 12/26/13 and I submitted petition on 2/5/14 to extend her stay under B-2 status. My mother left US for China on 4/3/14. The petition was declined on 5/12/14. The USCIS letter lists 3 reasons.
1) The petition was filed after the I 94 expired.
2) Did not provide the reason why the petition was not filed in time (I attached an essay to explain the reason actually);
3) Did not provide a reason to show that there is somthing beyong my control that caused the delay of the petition.
Now, do I file I-290 or do I ask my mother to get a new visa when she is ready to come back to US in about 6-8 months? How long does the I-290 process take? Will they give me an answer before my mother plans to visit again next time? How likely the "verdict" will be changed if I file I -290? Or does my mother have a better chance to apply for a new visa in China with my explaination in writing describing what happened and why the petition was filed late?
BTW,I myself has a green card and can apply for citizenship but I have not decided to do so.
