I filed two I-140s, the first one is EB1-OR based, filed concurrently with I-485 in Nov. 2002; the second one is EB2-NIW, filed in Feb 2003. In Sept 2003, I left the Univ.sponsing my OR for another Univ., but my current research is exactly the same topic. My NIW got approved in Oct 2003, and immediately I wrote a letter to INS, to inform them I am eligible for status adjusting. At that moment the OR was still pending.
I got a notice one week ago, it said:
Preliminary processing of the above application or petition has been completed, and it has been transferred to the INS office at New York City. That office will notify you when they schedule an interview on the application or petition. Any further inquiries should be made to the office.
Today I was told that my OR has been denied because I left my previous University and my current position is not a one like tenure. So I just concern if this have any adverse effect on my I-485 case. Please let me know if I need to file another I-485 based on my approved NIW. Currently my employment is based on my EAD, which coming with I485. I need to renew my EAD also, where the form should go, the local NYC office or VSC? I am looking for ward to your kind suggestions!
