I am a pstdoc in A University on H-1B, and I got a job offer from C company last December, but I could not work for C company because of no H1-B quota (I also don’t have a US degree). C company really wanted me to start working for them as early as possible, so they came up with this solution: Since C company have collaboration with a nearby B University on the project which I am going to work on, so they arranged that I transfer to B University first and work on C company’s project, then after April C company will apply for new H1-B for me to work in the company after October. I got an offer from B University and B University has filed H1-B transfer petition for me and I am waiting for the receipt from USCIS to start to work in B University.

My concern right now is that I heard that it will take up to 6 months to obtain the final approval from USCIS for a H-1B petition (not a premium one), although I can start work for B University after I get the receipt,one bad situation would be when C company file new H1-B petition in April for me to work in their company but the H-1B for B University has not finally approved yet. So it is like filing new H1-B petition while have another H1-B petition pending, and I am assuming this would cause problem from what I read from this baord, right?

One fix to the above problem would be filing for the current H1-B transfer in premium process so that I can get the first one real quick before Arpil. I heard one can ask for premium process (pay $1000) even after the petiton has been filed, anyone could confirm?
