The Omnibus Appropriations Act for FY 2005 contains provisions for the H-1B visa status. The Act creates a new Fraud Prevention and Detection Fee of $500. Effective March 8, 2005, all new applications for the H-1B status require that additional fee. This fee is not required for H-1B extensions or amendments.

Like all fees for the H-1B application this fee has to be paid by the employer.

All H-1B applications received by the Department of Homeland Security/United States Citizenship and Immigration Services (USCIS.) on March 8, 2005 and thereafter have to include this additional fee.

The following fees will be in effect:
Normal processing fee: $185.00
Fraud prevention and detection fee: $500.00

Premium processing fee (only if premium processing is requested): $1,000.00
