BS + 5 years for EB2? xiaojun2005-02-18 22:08:51

Any advice/suggestion would be appreciated.

My RIR filed last september and it is believed that it has been moved to BEC. Talked to my current employee to refile under PERM, and got rejected.

Currently got a job offer, but it looks only BS required. Talked to some attorneys, some said it is possible to do EB2 for BS + 5 years, some said there is risk EB2 is not permitted.

My concern is: If I am allowed to go to EB3, what consequences? I understand EB3 is retrogressed and I have only 3 years left on H1B. According to FANlaw, if I140 is approved, it is not allowed to extend H1B after 6 six years providing I485 is not filed. Is it true?

So many people with Eb3 what they do?
