Almost every NIW applicant know the three criteria set by USCIS for NIW:
1. Proposed work is in an area of substantial intrinsic merit
2. Proposed benefits are national in scope
3. National interest would be adversely affected if a labor certification is required
I work in a biomedical area Usually there is no big problem to convince USCIS that the petitioner meet the first two requirements. The difficulty comes from the 3rd one. Basically, the answer for this question is I am playing an irreplaceable role in the proposed work. Without me, proposed projects can't be done. However, my boss did not write the recommdation letter in this way even I told him about it. He wrote: I am doing a extremely important job and I have unique skills. .... it is good enough?
