I am F1 with OPT which expires on 5/31/05. Last year, my wife filed her I140 and I got my I485 EAD. This April, we just sent out all necessary documents regarding of I140 REF.
I applied to change form F1 to H4 in April, at that time, I didn't know those 20,000 additional H1-B would be available. But I requested my H4 status start from 6/1/05.
The lwayer of my compay filed application for new 20,000 H1-B yesterday, but i received H4 approval notice this morning, with beginning date is 5/5/5. Because a I am still working within 5/5/5 to today (5/12/05), does this mean I already chose to us my I485 EAD
Also my lawyer told me I am safe to stay here if I can get H1-B before the denying of my wife's I140, is this true?
This stupid H4 approval notice changed all my hopes to a nightmare, could I do something to it?
