I am working in a company’s regional office in MD. Currently, our company headquarter (in CA) has an aproved LC. The applicant for this LC left company.
AFAIK, this LC is transferable to other applicants in the same job category under the same employer. However, when I met with HR to discuss the transfer issue, she expressed her concern about the location, i.e., LC is transferable under the same **location**/job category/employer. If I insist to do so, I have to move to CA which I would rather not to. Here are my questions regarding this:
Q1. As per HR, an amendment to address INS is required for LC transfer. My question is: is it mandatory or optional (random sampling cases)?
Q2. If amendment is required, how long will it take to have it approved?
Q3: Do I really have to move to CA(by law)?
Q4: If I do, when should I do it to minimize time away from my home:
A) Before the amendment is filed.
B) Upon amendment is approved and LC is granted to me.
C) Upon I-140 is approved.
D) Upon I-485 is approved
E) Other _____
