I have an urgent question to ask you: About "I-824".

An example: At the time I-140 got approved, kid was below 20 years old. Submitted I-824 for kid before his 21th birthday (Kid is in China). But due to retrogress, after several years even parent's I-485 gets approved in US, but kid will be over 21 in China.

Some lawyers said as long as the I-824 is filed before kid's 21, then no problem because kid will be protected by Child Status Protection Act (CSPA), kid still can get immigration visa in Guangzhou, China.

But some lawyers have different comment: filing I-824 before kid's 21 will not guarantee that kid will be protect by CSPA, only filling I-485 is OK. In another word, if kid is over 21 at the time his parent's I-485 get approved, even though I-824 has been submitted before kid’s 21, he(she) is still not eligible to get immigration visa in Guangzhou.
