I just got FRE from the Director of TSC, officer #449. All of this is due to my terrible mistake.

I am a post-doc at a children cancer research institute. I had no any idea about GC application before the end of this Sep. When I got to know the retrogression, there was only a week time left. I prepared everything in a rush by using my friend's package, EB1-EA. At that time, I did not know I should apply for NIW.

Today, I got the FRE for I140 of the EB1-EA I submitted at Sep. 29. The following is the information:
This officer is unable to complete your petition without further information. Please read and comply with the following.
(1)
The classification you seek is "alien of outstanding ability in sciences,........". Please submit any three or more of the following:
Internationally recognized prize or award;
Membership which requirs outstanding achievements;
Published material or major media about the alien's work;
Judgement of other's work;
Evidence of the alien's scholarly articals in the field, in major publications or major media;
Evidence of display of alien's work in exhibitions or showcases;
.............

Addtionally, under section xxxx of the immigration act, The classification you are seeking requires that "(i)alien of outstanding ability in sciences,........, (ii) the alien seeks to enter the USA to continue work in the erea of extraordinary ability, and (iii) the alien's entry into the USA will substantislly benifit prospectively the USA (the third one is emphasized by bold by the officer).

Please submit evidence to establish the significance of the activity in which you are to engage if granted classification as an alien of extraordinary ability(EA). What kind of work will you be doing in the USA? What consequences would occur if you are not to work in the USA? What is the overall effect of this work to USA? Please submit documentary evidence as appropriate to suppurt your response.

Please explain in detail how your work is said to be that of EA by your peers and how is significantly above that encountered among others who are engaged in your line of work. What distinguishes you from others who have the training and background? What sets you apart from others who are doing the same work as you?

You may give further details about how the evidence submitted relates to the criteria listed above. (this sentence is emphasize by underline by the officer).

My qualification is:
12 papers with 4 first, 40 citations. One paper was submitted to a CNS Journal and the progress of another project is very good (all cancer related).
One conference award, one of five winners out of 1,500 attendents in a international meeting.
Membership: Sigma Xi. I will get AACR membership soon.
Never review other's work.

I know my case is much easier for NIW. Unfortunately I mistook it as EB1-EA. I can re-submit NIW, but the 485 is a long way to go.

I really do not know if I could fight back after RFE. It seems the officer did not pay much attention to the document I submitted.

Please give me some suggestions!
