Can apply Ap only or need necessaryly with EAD? Foggy2005-12-07 01:34:46

Hi,all,
I have questions about AP.My hu*****and and I are both on H1B VISA. I filed NIW 140 AND 485 IN MAY,2005.140 approved, my 485 and my hu*****and 485 pending. Because of family emergency,He needs go back to China now. So he will apply AP.Is it necessary for him apply EAD too? Once you use Ap,is H1b still valid when you reenter US?
We filed 140 and 485 by lawyer,can we file Ap ourself?
