Purpose of the form (I-131):
Reentry Permit;
Refugee Travel Document;
Advance Parole Document;
Note:If you are in the United States and wish to travel abroad, you do not need to apply for Advance Parole if both conditions described below in number1 and 2 are met:
1. You are in one of the following nonimmigrant categories:
H1,or H4;or
L1,or k4;or
K3,or K4;or
V2,or V3;or
2. A Form I-485, was filed on your behalf and is pending with USCIS.
However, upon returning to the United States, you must present your valid (H, L, K, V) nonimmigrant visa, and continue to remain eligible for that status.
我(H4)和先生(H1), 我们的485正在pending中, 今年夏天(大概5,6月份)想回国. 我们的情况正好满足Note中的两个条件, 那么我们是否还需要申请AP? 如果不需要AP, 那么返美入境时是否只需要出示有效的VISA即可?
