2003年递的LC (using regular process),到现在一点消息都没有。现在公司同意我们从新
file using PERM。我现在的case是EB3。我目前有3各options:
1. refile using PERM to apply LC. if the new case is identical to my existing case, DOL could keep my priority date (end of 2003). But the risk is DOL will decide if two cases are identical or not. if they reject, then I will loss my priority date.
2. start over a new case using PERM and apply under EB2. then I will loss my priority date for sure. but EB2现在的排期推进得很快．我或许可以更早开始申请485.
3. nothing to do. just keep my current case and wait for LC, 然后等到排期后递交140 and 485
我的H1b到２００９年底就要满６年了。
