I filed my I-140 under the categary of NIW by myslef. Recently, I received a
letter from the Immigration Office for more evidnece. Below is the content of
the letter.
This office is unable to complete the processing of your petition without
further information. Please read and comply with the following request below,
then submit the requested evidence to the above address, including a copy of
this letter anf the attached gold sheet. You must submit the information
within twelve weeks from the date of this letter. Failure to do so may result
in the denial of your petition.
The petitioner is seeking classification under Section 203 (b)(2), as a Member
of Professions with Advanced Degree or of Exceptional Ability. In addition,
petitioner is requesting that the job offer and correlating labor
certification from the department of Labor be waived in the national interest.
The evidence indicates that the beneficiary's work is of substantiall
intrinsic merit and is national is scope. However, the evidence fell short of
fulfilling the criteria and the following assitional evidence is needed:
Please submit a copy of the Defense Advanced Research Projects Agency and Air
Force Office for Scientific Research grants that the self-petition plays a key
role in. As in past grants, the key principle researchers are listed. A
letter of support from them would be beneficial.
Please submit further evidence to persuasively establish that the national
interest would be adversely affected if an employer were required to obtain a
labor certification from the US Department of Labor. Would a U.S. worker with
the same minimum qualifications be able to perform the same occupation and
serve the national interest to a similar degree? How will you serve the
national interest to a substantially greater degree than other individuals in
the area of endeavor? Please submit persuasive documentary evidence to
substantiate your response.
Here is my case situation. I got my PhD in China and am a postdoc in a US's University. I got more 20 papers published, among wich more than 10 were published in international Journals, and two patents, one of which has been issued. I have more than 30 citation records. I got 6 recommendation letters. One of them is a member of the American Academy of Art and Science. I though my case is not too weak. But I still got RFE.
I do not know, in this case, how to deal with the questions in the last paragraph. I know you from thde wenxuecity immigration doard. Many people praised you on your kind work and expertise in NIW RFE. Therefore I come to you. Please help me out of this problem. Do I need to prepare more recommendation letters or what should I do to convince the officer. Your kind help is highly aprreciated.
