My case:
EB2-RIR, TSC.
PD: AUG-2001
LC approved; OCT-2004.
I140/1485 RD: 1/18/2005
I140 approved: 2/2005
FP: 7/1/2005
LUD: 7/5/2005
Since Jan-2006 ( PD current), call 1-800-375-5283 3 times, get 3 letters, all telling me my case was delayed due to security check, and CIS has no info and date on how soon it can be cleared. Fianlly called to TSC directly last month, and was told my name check was send to FBI 1/2005 ( looks like they send it immediately after receiving it), still pending in FBI.
Do 3 things immediately:
1) File FOIPA . Returned last week to ask for filing again since FBI does not accept any FOIPA by fax, you must mail it.
2) E-mail FBINNCP@ic.fbi.gov, till now, no reply.
3) Mail Mr.Hardy for help, no reply.
Together with my colleague ( she has the same situation with me), we consulted one lawyer, he suggest we may file a law suit, just hestitate to do that in order not causing any bad sequence, but other than that, really don't know what to do next. It looks my case my sit in FBI forever.
