I did not work between June 16-Aug. 15. Does H1-B pending allow me to stay legally in US with a non-immgrant status? In another words, Will I have valid H1-B after my new H1-B is effective on Aug. 16? My primary concern is that I want to keep H1-B status while my I-485 is pending. Your answer to my old questions (attached below) was:

(As my opinion, you'd better leave USA two months for vacation ,in order to avoid the gap.Unless you decide to rely your pending I-485. If you work with EAD between June to Aug.,you have to get a new H1B visa out of USA.)

I was in dual H1B and I-485 pending status before my previous employment terminated on June 15. My new employer applied for H-1B on June 14(one day before the termination of my previous employment) for my new employment starting from August 16.(There is a gap between the two employments). I have only I-485 pending status (plus H1-B pendig status). (1) Will the application filed by the new employer have any adverse effect to my I-485? (2) Can I go back to H1-B status from soly immigrant I-485 pending status while my H1-B is pending? (3) Do I have a valid H1-B status after Aug. 16? (4) Do I need to use EAD to work for my new employer?
