I cocurrently filed my NIW last september. I-140 has been approved, and I plan to refile EB-1a I-140 since China EB-2 will be retrogressed again.
Here is my concerns:
1. If I just submit I-140 for EB-1a and if it is denied, would it affect my approved NIW 140 and old pending 485?
2. Since our name checks (My wife and I) have been cleared (inquiry via both of InfoPass and phone)and the NSC EB485 processing date has reached November 1st 2005 (AILA website), is it better to just submit EB-1a 140 and relink it to old 485 after approval.
By the way, could you experts help evaluate my case to see whether I have a chance for EB-1a, my basic background:
1. MD and PhD
2. 18 publications including 4 first author and 2 senior author.
3. reviewer for international journal.
4. Recent publication was reported by many medias.
5. membership of the American Association of Immunologists
And I heard that the reference letter for EB-1a is not as stringent as for NIW, is this right? Thanks so much in advance!!
