由于可能的eb2的再次倒退, 越来越多的申请人开始对eb1-a产生了兴趣. 大家都想知道自己是否符合eb1-a的要求?, 或者该不该试一试?, 被批的可能性有多大? 是否需要请律师? 在此提出我个人的意见供大家参考 (兼答一些网友的咨询). 希望能起抛砖引玉的作用.
在相关的文件中(或见140说明), 你可以找到下面的有关eb1-a 的要求.
to qualify as an alien of extraordinary ability in the sciences, arts, education, business, or athletics, the law requires the applicant to some of the following evidence to prove that the alien has sustained national or international acclaim and that his or her achievements have been recognized in the field of expertise. the regulations require submission of
1. the evidence of a one-time achievement (that is, a major, internationally recognized award), or
2. at least three of the following:
1) evidence of the alien's original scientific, scholarly, artistic, athletic, or business- related contributions of major significance in the field;
2) evidence of the alien's authorship of scholarly articles in the field, in professional or major trade publications or other major media;
3) published material about the alien in professional or major trade publications or other major media, relating to the alien's work in the field for which classification is sought. such evidence shall include the title, date, and author of the material, and any necessary translation;
4) documentation of the alien's receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor;
5) documentation of the alien's membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields;
6) evidence of the alien's participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specialization for which classification is sought;
7) evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation;
8) evidence of the display of the alien's work in the field at artistic exhibitions or showcases;
9) evidence that the alien has commanded a high salary or other significantly high remuneration for services, in relation to others in the field; or
10) evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.
一般来说, 大家都不具备a one-time achievement (a major, internationally recognized award). 所以申请人要做的是在所列的其他10个条件中, 对照自己的条件, 看一看自己能符合几条. 对于大多数作研究的人来说, 能够值得大做文章的也就是条件 1), 2), 和 3). 条件4), 5), 6), 和 7) 因人而异, 越多越好, 除了给予适当的描述, 让移民官了解它们得来不易之外, 你无法再做其他的发挥. 条件8), 9), 10), 适用于搞艺术的申请人, 对大部分搞研究的人来说, 是可望不可及的事.
那么该不该试一试?, 被批的可能性有多大? 是否需要请律师?
一般来说, 只要符合任何3条 或3条以上,都可以值得一试. 毕竟每个人的运气都不一样. 如果你自己做的话, 万一被拒, 最多也就是损失一点申请费. 如果你请律师做, 那就要慎重一点, 除非你钱多的烫手.
对于大多数搞研究的人来说, 如果你能符合条件 1), 2), 和 3) 中的2条, 条件4), 5), 6), 和 7)中的二条或二条以上, 你就可以放心大胆的试一把.
关于请律师的问题, 因每个人情况不同, 很难有统一的答案. 要根据你的经济情况, 时间, 精力, 和你对移民知识了解和移民进展的情况来决定. 律师的主要任务就是准备申请信 并提供指导收集其他材料. 如果你能找到经验丰富,而有负责的律师, 那是你的福气. 如果律师不愿接你的案子或者你不想雇佣律师, 那你得自己动手, 借助一个好的diy pkge,你可以同样充满信心去准备你自己的case. 好的diy pkge应该是一次成功的, 如果是有rfe的, 觉得还是慎重的好, 除非你也准备等着rfe的通知. to hire a lawyer or diy, it is up to you.
关于推荐信的问题, 找人写推荐信的确是一件很痛苦的是, 如果你已办过niw, 那么用于办niw的材料和推荐信的复印件,完全可以用来准备你的eb1 case. 无需再另外索要推荐信. 当然申请信需要重新写, 因为eb1的要求和niw是不完全一样的.
