Dear experts:
I have questions on my H1-B VISA application in China.(I applied my I-485 during my F-1/OPT period. My OPT expired last month but my H-1b will effective Oct-01-2006. Thus, I cannot adjust my status from F-1 or AOS to H-1b directly. So my company's lawyer told me that I have NO I-94 attached on the approval notice. Thus, I have to leave US for H-1b visa.)
Thanks for your answers to the next questions.
My situation:
Currently, I am I-485 pending and working with my EAD (C-9). My H1-b petition was approved this April but I have to leave US to China to get the H1-b visa because my OPT expired in July my questions are:
1- What kinds of document I should bring for the H-1B visa interview in China?
2- If my H-1B was rejected, can I use my AP to come back US?
3- Can I apply H-1B visa in Canada / Mexico? If rejected, can I come back with my AP?
4- If I use AP to come back, what document I should present to the custom?
Thanks and great thanks TAHKS and XieXie.
