My brother is in Australia studying in a master degree program. There is a company in the US can apply a H1 visa for her. This company does business with China. The position for my sister is Foreign Law Advisor since my sister's major is Law. However, this company that used to do a lot of business has very little revenue right now and very few employees. We are afraid that the Labor department will not approve the application when we file for LCA.
Could you please advise whether it is possible for my sister to get the H1 visa? Do the labor department or the INS care about or invest the sponsor/employer? How can we make the case? Assuming the H1 application being refused, would it impact my sister if she apply other types of visa in the future?
