My hu*****and’s company filed for his GC at the end of 2004 under RIR. His case is currently at Dallas Backlog Elimination Center. He got his 45-day notice about 3 months ago. But per the tracking system, his LC case is still shown as “in process”. My company (we work at different companies) approached me recently to ask me whether I’d like to file for the PR. If I decide to proceed, it’ll be filed under PERM. And it seems step 1 and 2 are moving very fast for people who filed under PERM. So I’m a bit torn regarding whether to file or not: apparently if I file, my priority date will be much later than my hu*****and’s. So if he gets his LC before I do or at about the same time, he’ll get the GC first. However, if his LC moves too slowly, then it’s worth the $ to file for another process through my company.

So should I file under PERM or not?

Another issue is that my hu*****and just reached his 6-year limit on his H-1b. His company has filed for an extension. Not sure whether this will have any material impact on his GC process in the future.
