I had filed H1b peptition and received approval notice for class H1B valid from 10/01/06. Yet it mentioned that I am not eligible for the requested extension of stay. It advises that I may depart US and then reapply to reenter in the H1b. In addition, it said " since the peptition indicates the worker will not require a visa to reenter the US, we have notified the port of entry listed above of the approval of the classification".
My I-140 was filed May 2004 and was approved on sept 2005. I had filed I-485 Sept. 2005. Last time I checked for my I-485 on May 2006, it was under name check. I used my EAD now, which will be expired on Nov 5. Should I apply for EAD and advance parole, then go to canada to get my H1 visa?
what is the best choice for me to proceed.
