如 果 在 旧 公 司 被 lay off 后 ， 先 到 社 区 大 学 转 成 F1身 份 ， 后 来 找 到 新 工 作 ， 那 么 再 办 H1B时 占 用 当 年 H1B名 额 吗 ？ (我 知 道 如 果 是 直 接 从 一 个 公 司 transfer到 另 一 个 公 司 就 不 占 用 新 名 额 。 )
还 有 一 个 问 题 ： 如 果 在 旧 公 司 的 时 候 已 经 开 始 办 绿 卡 ， 并 且 劳 工 卡 和 140都 批 下 来 了 ， 而 485由 于 排 期 未 到 而 没 法 递 交 。 那 么 在 新 公 司 重 新 办 绿 卡 的 时 候 ， 可 不 可 以 使 用 第 一 次 申 请 绿 卡 时 的 priority date? 我 在 别 的 网 站 上 看 到 过 这 个 说 法 ， 可 是 不 能 确 信 。

如果原来公司没有撤销LC，应该可以用原来排期.

撤销劳工证与否政府机构不会告诉你，你可以先递交I-140/485, 如果被打回来，自然就知道了.

LC本来就可以是未来的雇主，原来公司同意等你拿到绿卡回来就行。

Notifing CIS after layoff usually means only to withdraw H1. When your employer revokes the H1, they may or may not withdraw your approved 140 at the same time. We do not know whether they did it. But probably they did. However, you still can use the PD of the approved 140 according a recent CIS memo.

1. Generally, many companies, especially, most big comanies and consulting companies, do withdraw 140 after the beneficiary left the company. I do not have number, but it seems that majority of them do that. Withdraw an 140 is as easy as writing a letter to CIS.
2. It is very rare that a company withdraws an approved LC, partially because an approved LC can be used for another person.
3. No matter whether an approved LC or approved 140 is withdrawed, once 140 is approved. A PD is established. You won't lose the PD unless CIS revoke the 140 due to the fraud or willful misrepresentation(they need special procedure to do it).
The exactly language of the recent memo about it is as following.
Determining the Priority Date. In general, if a petition is supported by an individual labor certification issued by DOL, the priority date is the earliest date upon which the labor certification application was filed with DOL. In those cases where the alien¡¯s priority date is established by the filing of the labor certification, once the alien¡¯s Form I-140 petition has been approved, the alien beneficiary retains his or her priority date as established by the filing of the labor certification for any future Form I-140 petitions, unless the previously approved Form I-140 petition has been revoked because of fraud or willful misrepresentation. This includes cases where a change of employer has occurred; however, the new employer must obtain a new labor certification if the classification requested requires a labor certification (see the section on successorship of interest).

So you need to include a copy of 140 appoval notice when filing the new 140 to request the retention of the early PD.
