I am in Arizona. Does this company break the employment agreement? If the answer it "yes", what is the time limitation? Do I need contact EEOC first to get ready to sue letter? Anything I should to know if I have to sue. What is the federal law code and state law code for this problems?

If the company does not give a H1B person severance package after he get laid off, Does Company break the contract? He is laid off at last day of his visa expired. H1B visa always has an expired date by its nature.
