My EB2 priority date is Sep 2005 and the I-140 just got approved. My EB3 LC from backlog center also got approved several months ago, and my EB3 priority date is Sep 2004. Now I plan to file my EB3 I-140 through premium processing, in order to carryover the priority date. Since my case is backward (got EB2 approved first and plan to file EB3 later), how big is the chance that my EB3 I-140 filing will not be accepted by INS?
