I am an H1-B holder from a university for almost one year. My supervisor mentioned to me today that it is very likely that he has to terminate my postdoc position after June 1 next year as the funding will run out after that. I have already decided to switch to the industry next year, I will try my best to find an industrial job offer and ask my new industrial employer to file the new H1-B petition for me before my postdoc position gets terminated.

Since the new H1-B for industry can start for me until as early as Oct 1 next year, it is legal for me to stay (without working) in the U.S. during the four months' H1-B gap? Does it matter when the new H1-B is approved, so long as I get the new H1-B receipt before my current position expires?
