As a research fellow working under H1B visa, I am preparing the GC appliation now and would like to file the application (EB1a or NIW) anytime.
My problem is that I am going back to school this April. It is a full time clinical program which requires me to have a valid visa ( F1, H4 or 485 pending) to study.
Originally I planned to apply for an F1 visa to start the program first and then apply NIW for GC later. That is why I did not worry preparing the GC documents at all. Last November, after noticing the premium processing and concurrent filing policy for EB1a. I decide to give a try for EB1a. I thought I should be able to get a notice, either approved or rejected, in a short time, so that I can decide the next step appropriately. Say if approved, I can proceed to 485 pending and use this for both my full-time study and part-time research work. If rejected, I would apply for an F1/H4 visa and forget this GC thing.
After browing this website, I found that a lot of EB1a case got RFE after premium processing. What shall I do if I get an RFE too? I won't have enough time to complete both the I-140 approval and the student visa thing.
Any idea if I can go to Cannada to apply H4/F1 after filing I-140? I know for sure that using H4/F1 at custom means giving up the I485 petition, is that the same for I-140 petition (not concurrent filing)?
