I am currently on H1 status (no visa stamp) and it will be good until end of March 2009 (There won't be change of employer situation for me). I am planning to go back to China for a conference in November. If I apply for AP (AP only, not applying for EAD), can I still use my H1 to work when I come back to US? From reading all the discussions here, I got the impression that I don't have to use EAD to work (I can still use my H1) after returning to US. Is this true? Please help me to clarify this.
