I got LC approved and I140 has been pending for about 4 month now. and I will file 485 since my number will be in current in July. I applied my LC and 140 in city A, then relocate to city B (city A and B are in same state), only working location changed, all others remain exactly same. The following is the response from my lawyer about my concern on "working location change:
As for the job change, if this is inconsistent with your labor certification, you will need to fill the original role upon the grant of permanent residence. If your adjustment pends for more than 180 days, however, you will become portable and will therefore not have an obligation to assume the original role.
does this mean if I my 485 and pends for more than 180 day upon the grant of GC, I will be fine for this relocation; if my 485 pends for less than 180 days, then I might be questioned and my lawyer might need to an amendment for my LC or 140? XiaoBaitu, could you please confirm if my understanding is correct? do you think if less than 180 days, my case might get rejected due to such location change?
