I hold H1 visa and now I am at 140 pending (not approved yet), I submitted 485 on July 2nd. My question is whether I need to submit 485 for my hu*****and.
I applied H4 visa for my hu*****and two years ago together with my H1 visa application. He travels between China and USA, most time he stays in China. However, two years ago, he got B2 visa with multiple entries in Beijing although he applied fro H4 visa.(the visa officer think B2 is more convenient for him) He had been using B2 since then.
I have the following concerns:
1. We don’t think we should apply AP for him since he needs to leave USA soon and he has to come back in two month. It may takes long time for us to get AP. That is why it may not be wise to apply AP now.
2. However, can he use his B2 visa again after his 485 application? Or, will he be able to obtain H4 visa in Beijing after the 485 application?
3. After the 485 application, is there any requirement how long he should stay in USA each year?
4. can he leave without receiving 485 receipt?
