Now H-1B five years and the H1 status will expire until mid 2008. Last year reentered US via AP. Now parolee. Didn't receive RFE of I-485 for 3 months. Called USCIS one month later after RFE mailed out. Today, received mail from USCIS saying if still havn't received RFE call them again to ask for resend the RFE. Contacted Senator's office and was told the I-485 case was forwarded to their clerical unit for abandonment denial. So questions are if you are still not confused and know something about it: 1. Should I do extension of my H-1B ASAP for a back-up? When can my status change to H-1B from parolee? After the receipt notice of H1 extension or after approval of it? 2. During the period of 'motion to reopen' if I receive the denial notice, can I still work legally as H-1B?

yes, you can extend it to 6 year limit
