I have 1.3 years of work experience after graduation and about 1 year of teaching (full control, independently) experience during my phd study. Still these two add up to slightly less than 3 years requirement for EB1b requirement (a gap about 4 month less).

Do I need collect letters supporting that my phd research was outstanding to fill the gap of work experience? Do I also need to collect letter supporting my teaching during phd study counts as experience as well. So far, all I have is in my department support letter, it is stated that "I have three years of teaching/research experience". That's it. More worse, my stupid lawer did not even read my I140 package and submitted the application already two days ago, without even mentioning the 3 years work experience issue in the cover letter.

Now what should I do next? Try my luck with the USCIS or withdraw my I140 application and refile again with better supporting letters and mentioning it in the cover letter? If this time my application were denied, will it affect my next Eb1b application? Will a withdraw affect my future application as well? I can't get my $475 appliation fee back if I withdraw, right? My background seems fine, a permanent research position at an ivy university.
