I landed and became a permanent resident of Canada on Jan. 2, 2008. When I re-entered US at the Ottawa airport yesterday, the US immigration officer made remarks in my file in the computer that as a landed Canadian immigrant, if I come to Canada from US next time, I must have an H-1B visa to re-enter the US from Canada and I can't use Automatic Revalidation any more.
When I asked him if I can use AP instead of an H-1B visa to re-enter US from Canada, he didn't answer me, but asked me if I'm adjusting status in the US now. I said: Yes. The case is pending. Then he said that you must make a decision to cancel one. You can't have two to enjoy both benefits.
The officer wrote remarks in my file that I just became a permanent resident of Canada on Jan 2, 2008 and I’m having I-485 pending in the US.
1. Do I need to cancel my permanent resident of Canada, while I'm applying for permanent resident of US (with pending I-485)?
2. I want to apply for AP & EAD. Will his remarks lead to rejection for my application of AP & EAD? How long does it take to get AP & EAD now? Will it be better that I apply for AP & EAD several months later, not right after I became a permanent resident of Canada?
