My scenario:
I, a Chinese citizen and H1B visa holder, posted my resume on line and tried to find a better job one month ago. Unfortunately, my current employer found my resume on line and had a conversation with me last week. A colleague will take over my responsibilities eventually. It is possible that my boss will fire me after the transition period. Now, I have to prepare for the worst scenario. I have not applied for any school yet at this moment. It might take a while to get an I-20 from my former school. I expect it may take up to three months to find a new job from now. I plan to maintain legal status and continue to hunt for a job even after being laid off. My questions are:
1. In case I was laid off, should I change status to B2 or F1?
2. If I change to B2, how long could I stay at the States and continue to seek for a new job?
3. If I change to F1, what is the quickest way to get an I-20? Community college, or my former school (I was a MBA student at Louisiana Tech).
4. If I go back to China and successfully to find a job in the States while I am in China within a year, will I exempt from the H1B cap?
Hope some one who had similar scenario will share his/her experience or insight with me.
