My son is going back to china this summer, but his h4 visa will be expired in May. The lawyer suggested he can use his AP back to USA, and after his return, he can file his H4 extension.because he can not travel while the H4 is pending. I have to file my H1B extension in April. But,I heard if someone has used his Ap for travel,his H4 extension will be denied? Is is true? How about your suggestion? Is my son be safe come back to USA, and apply H4 extension later on?
