One more question: My attorney told me today that the problem is once I leave the US,my H-1B will be a consular process H-1B.The approval notice won't have the I-94. Once I return, I will have to file an amended H-1B if I want to be in H-1B status.

My company wants to to travel to China in July. I can use AP to come back. However, my H1-B is under transferring. I ted in May and will take about 3 months to get approval. Please let me know :
Can I use AP to travel? What is the risk to come back with a different I-94 number? Thanks very much,
