My I-485 was denied several days ago because USCIS treated my EB-1(B) as secondary preference category by mistake. Today, I just filed an I-290B for motion to reopen and reconsider. Thank you providing me the precious info.last time.
I was working using EAD. Today, my company told me to stop work from tomorrow until I resolve the issue (time to allow back for work). Can I ask from which point that I should allow to work? When I receive the receit notice for my I-290B from USCIS, or until USCIS making a decision for the I-290B, or until my I-485 approved? I would really appreciate if you could provide any legal document to show from which stage I can go back for work.
My company told me in the period of stopping work I have no salary and benifits including medical insurance. Ai,I have 3 kids to feed, to go to hospital for regular check, and to go for school. It's a huge suffering because the USCIS's error. Do I have any way to ask the local USCIS to collect the mistake. Thanks.
