Need urgent help. My I-140 got denied. Need some help to fight with USCIS.
They used section 240 ( c ) of Immigration and Nationality Act to deny my I-140.
The General Attorney determined that the alias attempted or conspired to enter into a marriage for purpose of evading the immigration law.
I filed 1-485 before with my ex but the marriage did not work out. My ex wanted to seek annulment of the marriage and I consulted with some immigration attorney who told that will not effect employment based immigration. The annulment entered by default but denied at the 1st round. My ex had to make up statement like I married her for green card so it eventually got granted by a temp judge since I never attended any hearing.
Actually I did not only enter the annulment by default but also volunteer to cancel my I-485 application in 2007.
I tried to reopen my annulment case by since my labor stuck in backlog center for 3 years so I missed 1 year period of reopening annulment deadline. USCIS said they denied my I-485 on May 2004, but I never got noticed on that.
What I should do now? My ex does not seem to interest in helping me.
