My hu*****and lost job at Feb.26. The company paid him to April 24. His H1 I-94 expired at May 12. His company reported his layoff to Vermont immigration center at March, but we don't know that until last week. He filed F2 to California center and pending since May 9. Then last Month he found a job and filed H1 premium process on August 18. Last week we received notice asking for additional evidence for F2-- an I-20 and bank statements. We just prepared them and mailed to Cal center this Tuesday. Last week we also received notice asking for additional evidence for H1--last pay stubs and a letter from my former employer. Now we just prepared those evidences but haven't mailed yet.
The problem is that my F1 OPT expire today and I don't have job now, I wonder if my hu*****and's F2 will be proved? (We mentioned in the cover letter that we also filed H1 and hope the F2 is from May9 to the H1 effective day. Also we mentioned F2 pending in the H1 coverletter). I am not sure if the grace period helps? If my hu*****and's F2 is not approved late, then will he be out of status over 6 months? (Feb.29 until now). I heard he is legal to stay in US since he has F2 pending since May 9, but if F2 is denied late, will the period from May9 become out of status? If this is true, what we can do now?
Also will he leave and reentry US for the H1 I-94? Will the California center see his layoff record reported to Vermont center?
