Two 485s under different catagory, received same RFE by the same laodou19762008-10-10 03:06:00

My wife and I filed two sets of 485s around July and August 2007 under different category. One is under EB1b (140 just approved in August 2008), the other is under EB2 (PD: May 2006). Recently we received RFE for both sets of 485s by the same officer on the same day, asking for similar document such as copies of I20, I94, and EAD etc.

It appears that USCIS has already linked two cases together. Now we want to keep EB1 485, and withdraw EB2 485.

My questions:

1. Can we send a signed letter to USCIS asking for withdrawal of EB2 485?
2. Anyone has similar experience? If so, how did you handle this?
3. Will the withdrawal of Eb2 485 affect the approval of Eb1b 485s?
4. We consulted with the company Eb1b lawyer. He said how to deal with Eb2 485 is up to us, and it will not affect the approval of Eb1b 485. Is it true?
