Here is the case. My hu*****and was laid off and his H1 visa will be end in 1/1/09. I start filing H4 for him now and How long will H4 be approved?
If he finds a job after 1/1/09 and before H4 is approved and we withdraw H4 application. Does the new job H1 visa has to wait till 4/1 to apply?
Will there be a problem from 1/1/09 to the day of new employment H1 visa?
I read online that someone says if you withdraw H4 before it is approved and after your old H1 expires, you will be in illegal status during the period between old H1 and new H1. Is this true?
