My daughter hold H4 and started fall 2009 she became a full time undergraduate student. On Sept.03 she sent in I-539 to change status to F1. At that time, she sent the following documents:
1.cover letter
2. form I-539
3. original form I-20 from her university
4. proof of SEVIS Fee payment
5. Financial Document
-Parents letter
-Bank statement
-her university financial aid award letter
6. copies of both side of current I-94 card
7. Copies of passport identification page
8.personal check $300 for the required fee
On October 5 she received a notification from USCIS to submit evidence for her status change.The USCIS letter said,
"You have requested a change of status for the beneficiary. You must submit evidence that establishes that establishes the beneficiary's parent, XXXX has been gainfully employed by the petitioner from which he last obtained his H status and was granted admission into the united states.
You must demonstrate that XXXX has maintained the primary H status afforded to him on that date until September 3, 2009, the date thye present application was filed.
Submit copies of XXXX's pay statements from June of 2009 through September of 2009. If the pay statements do not reflect the employer's name, include a statement from the previous employer's human resource manager or appropriate company official indicating the dates of employment and the date of termination, if applicable."
From the USCIS letter, the last paragraph is clear state what they are looking for, but for the first 2 paragraphs we don't understand what they want.
XXXX is my hu*****and and he holds H1B from 10/01/2007 to 09/15/2010.
