I have an EB-2 140 approved in 2006 and an EB-1 140 approved last Dec. My 485 has been pending since 2007 attached with the EB-2 I-140. Since last Dec, I have requested to relink my pending 485 to the EB-1 140 via email and calls. I received an email from USCIS saying that they will pull my files out and put them together for processing and if nothing happens within 60 days I should contact them again. Then my 485 updated for multiple times in Jan and received an email from USCIS for RFE. We responded the RFE promptly since it was a very simple one. 485 case status was updated upon USCIS received the response to RFE. Since then nothing has happened. My lawyer called in and was told that they started a new review process for the case and asked us to wait for 6 months and if don't hear from them in 6 months we should file in another inquiry. After one month anxious waiting, I called in to USCIS and talked to a VO. I was so surprise that I was told that my case is still in EB-2 and not moving--none is working on it because there is no visa quota available. My lawyer insisted that we should wait and give USCIS more time for processing before we should do any new inquiry--and only through the lawyer. I read many posts in this forum and found that after USCIS receive RFE for 485s attached to EB-1s they normally approve the cases very quickly. Is this normal for this case to take this long? What the new review process would be? Will it be benefitial if I submit a written inquiry again requesting for relink? Or will an infopass to local office be benefitial or any drawback? Really appreciate your thoughts and kind advice! Thanks millions,
