You have indicated on your Application for Permanent Employment Certification A-1123x-01xxx, August 23, 2011, that you are seeking to utilize the filing date from your previously submitted Application for Alien Employment Certification (ETA 750), 02/05/2004, for XX. Based on the information you provided on ETA Form 9089, our office is unable to locate the referenced ETA 750 at the Backlog Elimination Center (BEC).
Please provide this office with additional information to better assist us in locating your ETA 750. Please submit a copy of the filed ETA 750 along with evidence that it was submitted to the local filing office, e.g. a certified receipt or a letter of acknowledgement from the local filing office. If a merger, acquisition or any other corporate change in ownership has occurred between the time of filing the ETA 750 and the ETA Form 9089, the employer must provide documentation proving that it is the successor in interest, i.e. that it has assumed the assets and liabilities of the former entity with respect to the job opportunity. Upon receiving the additional information, this office will initiate one additional search of the BEC records. If no record is found, the current PERM application will be processed and assigned a priority date based on the date of filing in PERM.
Please respond within 30 days of the date of this correspondence. Note: this request for information is being sent as a courtesy; if a response is not received within 30 days, the status of the ETA 750 as reported by the BEC, i.e., “No Record Found”, will stand.
