My friend's asylum was denied about 5 years ago and wants to file a new asylum application based on a completely different reason. Some lawyers said that a motion to reopen the denied asylum needs to be filed while filing the new asylum application. But when I looked through the instructions of I-589 and the Affirmative Asylum Procedures Manual, it seems to me that the motion is not required for filing a new asylum. I appreciate any advices to clarify this issue.
