A bit background: a couple married (in china) for > 10 years without kids. Both have been in the US for over 10 years. In the past 5 years, the couple lived in two states due to work reason. On average, during this period, they spent about 4 months together per year. No crisis in their marriage. They are actually considering moving together once 485 approved since there will be more job opportunities. Now the dependent is required to provide evidence to prove their marriage is bona fide.

 

Here is a list of things I have come up with. Could you please comment on the value of each of those? Many thanks!

 

·         Copy of marriage certificate

·         Copy of Deed of jointly owned real estate property

·         Bank statements from a joint account (1 statement per  year from 2005-2012)

·         Documents showing that the hu*****and/wife is the beneficiary of wife’s/hu*****and’s life insurance, 403(b), and Roth IRA

·         Federal tax returns from 20XX to 20XX (filed separately or jointly, not sure if this could be treated as evidence, especially these filed separately)

(The above are all legal or financial-related documents. The following is somehow soft.)

 

·         A brief story of our life since we married

·         A few selected photos

·         I-20 forms indicating hu*****and/wife simultaneously attending the same school from 20XX to 20XX

·         Previous rental history when lived together (This is hard to get I feel. I could not find related template for this, except rental verification)

 

Other questions:

1. In the request letter, it says “..., medical, school or religious records; or other proof of marital status” What kind of medical, school, or religious records is referred here?

2. There seems no requirement for interview. Should we expect that? When would that happen if there is one?

3. I-485 submission was totally DIY. It turned out to be good for the primary applicant case. Of course, I should thank you two for the extensive information provided and the online help. Do you think I should seriously consider hiring a lawyer for this RFE?
