MR.8, could you please help me on my following questions? Many thanks!
• I am holding an H1-B visa (sponsored by my current employer), with an I-485 Form submitted in Dec 2011 as a dependent of my hu*****and with a priority date Oct, 2007)
• Due to the fact that we are living in 2 states I received a Request for Evidence (RFE) to show me in a bona fide marital relationship with my hu*****and. RFE was responded right away with evidence included, such as a deed of commonly owned property and statements from joint bank accounts.
• I have an EAD/AP combo card.
• I will be traveling aboard in May (Destination: China).
• I accepted an offer from another company. The planned starting date is late June, 2012.
I was advised to keep a valid non-immigration status. Under the current situation (having a submitted and under processed I-485 Form with a RFE), the following is my questions:
• What is a better approach for me to be able to work for my future employer, transferring my H1-B or activating my EAD?
• Regarding my trip to China, in order to re-enter the US, should I apply a new H1-B visa under the sponsorship of my current employer or should I use the AP card?
• If I activated my EAD/AP card in May and later on my I-485 Application was denied, what would be the consequences? What actions should I take to be able to work for my future employer legally?
