I hold a TN1 working with a large/old company in New York and after 10/01/05, I will be a H1B holder (H1B has been approved but it is not effective yet).My employer will take care of my GC application (not start yet) through a large law firm but I don't know my case is belong to EB3 or EB2. I can't get the information from the law firm because my employer hires law firm not a specific attorney in that law firm and I don't know who should I contact. For example, my TN1 was one attorney and H1B was another attorney but both are in some law firm (I saw attorney's names only on copies of documents they sent to me for getting visa).

Here is my background:

1. B.Sc in engineering from China and a certificate of US equivalent.
2. 10-year professional experience in Canada (US companies, Canada locations).
3. 3 US patents (all first author) and one more in processing.
4. Licensed professional engineer in Canada.
5. Born in China.

Current position:
1. Project leader(manager).
2. Salary above skill level 4 (I checked a related web site).


Question 1: EB2 or EB3?I appreciate your any thought on what my case will be EB2 or EB3.

In addition, for our children going to public Universities in New York, do we need to pay in-state or out-state tuition fees? if I hold H1B. I have contacted a few public universities and don’t have a satisfied answer yet – they don’t give me a clear answer, instead of saying case by case and until an application received.
